TERMS AND CONDITIONS

IMPORTANT : LOOLAKOOLA supports several languages for the convenience of international customers. Policies in languages other than Korean and English were translated through Google Translate and are for reference only. Only the policies in Korean and English have legal effect.

 

01. Purpose

The Terms and Conditions state the rights, obligations, and responsibilities of LOOLAKOOLA and customers using loolakoola.com which is operated by LOOLAKOOLA.

 

02. Definitions

1) A website “loolakoola.com” is operated by LOOLAKOOLA to provide services to customers and allow customers to place an order.
2) “Customer” refers to a user who accesses loolakoola.com and receives the services provided by LOOLAKOOL A according to this agreement.

 

03. Specification, Explanation, and Amendment of the Terms and Conditions

1) loolakoola.com will post the following contents on homepage, in a way that customers can easily check. Contents include the Terms and Conditions, company name, name of the representative, business address where also consumer complaints can be processed, phone number, email address, business registration number, mail order sales registration number and Personal Information Protection Manager. Customers can access to the contents of the Terms and Conditions through a linked page.
2) Before customers agree to the Terms and Conditions, loolakoola.com must provide a linked page or a pop-up page that allows customers to confirm important details such as Shipping and Returns Policy so customers can understand the Terms and Conditions and other policies.
3) loolakoola.com can modify the Terms and Conditions within the scope not violating relevant laws. Relevant laws include the 「Act On The Consumer Protection In Electronic Commerce」, 「Framework Act On Electronic Documents And Transactions」, 「Act On Promotion Of Information And Communications Network Utilization And Information Protection」, and 「Framework Act On Consumers」.
4) When loolakoola.com modifies the Terms and Conditions, loolakoola.com will specify the revision date also with the modified Terms and Conditions.
5) The modified Terms and Conditions will be applied to orders placed after the valid date of the modification. For orders already placed before the valid date, the previous Terms and Conditions will be applied. However, if a customer who has already placed an order wants to be applied to the modified Terms and Conditions within the notice period specified in Paragraph 3(Specification, Explanation, and Amendment of the Terms and Conditions) and obtains consent from loolakoola.com, the modified Terms and Conditions will be applied.
6) Matters not specified in the Terms and Conditions and the interpretation of the Terms and Conditions shall be governed by relevant laws, guidelines for consumer protection in electronic commerce by the Fair Trade Commission, and commercial practices. Relevant laws include the 「Act on The Consumer Protection in Electronic Commerce」, 「Act on The Regulation of Terms and Conditions」.

 

04. Information and Change of Information on Products

1) loolakoola.com performs the following tasks:
(1) Providing information on products and processing orders
(2) Processing shipping orders
(3) Other tasks specified by the loolakoola.com
2) In cases such as out-of-stock or any changes in technical specifications of products, loolakoola.com will promptly modify the information of the products.
3) If loolakoola.com needs to make changes to the products that customers have ordered due to reasons such as out-of-stock or modifications in technical specifications, loolakoola.com will promptly notify the customers by email.
4) loolakoola.com is responsible for any loss of customers caused by the events stated above. If loolakoola.com proves that there was no intention or negligence on its part, loolakoola.com will not be responsible for any loss.

 

05. Suspension of Services

1) For maintenance, replacement or malfunction of information and communication equipment, loolakoola.com may temporarily suspend the operation of services.
2) If loolakoola.com temporarily suspends the service due to the events stated above, loolakoola.com is responsible for any loss of the customers. If loolakoola.com proves that there was no intention or negligence on its part, loolakoola.com will not be responsible for any loss.
3) In cases where loolakoola.com is unable to provide services due to change or discontinuation of business, it will notify the customers according to the method specified in Paragraph 8(Notice to Customers) and compensate customers according to the specified conditions. If loolakoola.com fails to provide prior notice of compensation standards, it will compensate the customers by providing them with goods or cash equivalent to the currency value used on loolakoola.com for their accrued points or similar benefits.

 

06. Account Registration

1) A customer can register an account by submitting the information according to the formats provided by loolakoola.com and checking the agreement to the Terms and Conditions and Privacy Policy.
2) Account registration will be declined for the following cases:
(1) If a customer’s account had been suspended previously under Paragraph 7-(3), except in cases where at least 3 years have passed from the suspension and loolakoola.com approves re-registration.
(2) If there are false information, omission, or errors in the registration details.
(3) If registering one’s account seems to cause technical difficulties for loolakoola.com.
3) An account becomes valid from the moment the approval from loolakoola.com reaches the customer.
4) If there are any changes to the customer information, the customer is required to update the account information promptly to reflect the changes.

 

07. Delete an Account or Account Suspension

1) A customer can request to delete the account at any time, and loolakoola.com will process the request promptly.
2) loolakoola.com may restrict or suspend an account for following cases:
(1) If false information is submitted during the registration processes.
(2) If a customer fails to make the payments related to the orders through loolakoola.com by the specified due date.
(3) If a customer disrupts other customers’ use of the websites or engages in activities that threaten the rule of e-commerce.
(4) If a customer engages in actions that are prohibited by laws or the Terms and Conditions while using loolakoola.com.
3) For restricted or suspended accounts, if prohibited action is repeated or there is no improvement within 30 days, loolakoola.com can delete the account.
4) If loolakoola.com decides to delete one's account, loolakoola.com will notify the account owner and provide a minimum period of 30 days to make a statement before the account deletion.

 

08. Notice to Customers

1) loolakoola.com can send notifications to customers by their email.
2) For notifications to unspecified numbers of customers, loolakoola.com can make substitutions by posting the notice on the loolakoola.com bulletin board for at least 7 days. Matters related directly to the customer's order will be notified individually.

 

09. Order Placement and Personal Information Disclosure Consent

1) Customers can place an order using the following methods, and loolakoola.com will provide the related information to the customers in easily understandable ways:
(1) Searching and selecting the products.
(2) Entering the recipient's name, address, contact information, etc.
(3) Confirming the contents of the Terms and Conditions, services with limited withdrawal rights, and shipping fee, etc.
(4) A mark indicating agreement to the policies of loolakoola.com
(5) Orders for products, order confirmation from loolakoola.com
(6) Selecting the payment method.
2) If loolakoola.com needs to provide the customer’s personal information to a third party, loolakoola.com will inform the customers and obtain consent regarding the following lists. (This applies even if the agreed-upon lists change.)
(1) The recipient of the personal information.
(2) The purpose of provided personal information.
(3) The lists of personal information to be provided.
(4) The period of retaining and using of the provided personal information
3) If loolakoola.com entrusts a third party to handle the customer’s personal information, the following lists must be notified to the customers and consent from customers must be obtained. (The same applies if the agreed-upon lists are changed.)
(1) The party entrusted with handling the personal information.
(2) Tasks entrusted for personal information handling.

 

If the lists are necessary for providing services and related to improving the customer’s convenience, the notification and consent may be omitted through notice in the Privacy Policy in the manner stipulated in the 「Act on Promotion of Information and Communications Network Utilization and Information Protection」.

 

10. Order Confirmation

1) loolakoola.com reserves the right to reject orders that fall under the following cases.
(1) If the order contains false, incomplete or misleading information.
(2) If a minor places an order for products prohibited by the Juvenile Protection Act, such as tobacco or alcohol.
(3) If accepting the order would cause significant technical difficulties for the loolakoola.com.
2) The order is completed at the moment the acceptance from loolakoola.com reaches the customer in the form of an order confirmation as described in Paragraph 12-(1).
3) Order confirmation from loolakoola.com must include the confirmation of the order, availability of ordered products, and contact to request modification or cancellation of the order and other relevant information.

 

11. Payment

Customers will be transferred to Paymentwall to check out. Paymentwall, a secured online payment system, accepts various online payment methods depending on the customer’s country.

As for Paypal as a payment method, LOOLAKOOLA reserves the right to cancel the order if the customer’s Paypal account was not verified.

 

12. Order Confirmation and Change or Cancel Orders

1) loolakoola.com will send an order confirmation to the customer by email for all orders.
2) Upon receiving the confirmation notice, the customer may request changes or cancellations to the order immediately if there are any issues in the order. If the customer's request is made before the shipping process, loolakoola.com will promptly process the request. If the customer has already made payment, the regulations of Paragraph 15(Withdrawal of Orders) will be applied.

 

13. Supply of Goods, etc.

1) loolakoola.com will prepare to ship the package within 7 days from the order. If loolakoola.com has already received the full or partial payment for orders, loolakoola.com will ship the orders within 3 business days from the payments. loolakoola.com will provide the customers with the information to track the progress of the orders.
2) loolakoola.com will clearly specify the delivery method, responsibility for the shipping fee, and the estimated delivery time for the order. If it exceeds the estimated delivery time, loolakoola.com will be responsible for any loss of customers due to the delay. If loolakoola.com proves that there was no intention or negligence on its part, loolakoola.com is not responsible for any loss.

 

14. Refund

When loolakoola.com is unable to process the order due to reasons such as out-of-stock, it will promptly notify the customer. If payment was made in advance, loolakoola.com will process refund within 3 business days from the date of payment.

 

15. Withdrawal of Orders

Paragraph 15(Withdrawal of Orders) shall be applied to domestic customers within South Korea. International customers are required to check the policy about withdrawal here.

1) Customers who have placed orders on loolakoola.com have the right to withdraw their orders within 7 days from the confirmation of the order, or delivery(if delivery is later than the confirmation of the order). If there are different provisions in the 「Act on Consumer Protection in Electronic Commerce」 regarding this matter, those provisions will be followed.
2) loolakoola.com does not accept return or exchange under the following cases:
(1) If the product is lost or damaged by the customer.
(2) If the value of the product has decreased by the customer.
(3) If the value of the product has decreased significantly over time.
(4) If the original packaging of the product, which can be replicated, is damaged.
3) If loolakoola.com did not provide clear and accessible information about the restrictions on withdrawal of an order for the situations mentioned in Paragraph 15-(2), then the customers are not limited from exercising their right to withdraw of an
order.
4) Regardless of the Paragraph 15-(1) and Paragraph 15-(2), if the product is different from what was indicated, customers can request withdrawal within 3 months from the delivery, or within 30 days from the customers being noticed.

 

16. Effects of Withdrawal of Orders

Paragraph 16(Effects of Withdrawal of Orders) shall be applied to domestic customers within South Korea. International customers are required to check the policy about withdrawal here.

1) When loolakoola.com receives the returned products from the customers, the refund will be processed within 3 business days. In the event of any delay in the refund by loolakoola.com, loolakoola.com will compensate the customers for the delay interest calculated by multiplying the delay period by the delay interest rate. This delay interest rate is specified in Article 21 Paragraph 2 of the 「the Enforcement Decree of the Electronic Commerce Consumer Protection Act」.
2) In the case of refund requested by customers who used a credit card or electronic payment methods, loolakoola.com will promptly request the refund process with payment provider.
3) The responsibility for return due to withdrawal of an order is solely on the customer. loolakoola.com does not charge any penalty for withdrawal of an order. If the product is different from the description or the contract was not fulfilled as agreed, loolakoola.com will bear the cost of return.
4) loolakoola.com will clearly indicate the responsibility of customer for shipping fee of the withdrawal of an order, even if the customer paid for the initial shipping fee.

 

17. Protection of Personal Information

1) loolakoola.com only collects the minimum necessary personal information required for providing services.
2) loolakoola.com does not collect information required for orders in advance during the account registration process. If pre-verification is required before placing an order under relevant laws, a minimal amount of specific personal information can be collected.
3) When collecting and using customer’s personal information, loolakoola.com informs the customer of the purpose and obtains consent.
4) The collected personal information cannot be used for purposes other than the intended purpose. In cases of new purposes or providing information to third parties, loolakoola.com informs the customers of such purposes and obtains consent before applying the modification. Exceptions will be applied if specified otherwise by relevant laws.
5) When loolakoola.com requires the consent of customers under Paragraph 17-(2) and Paragraph 17-(3), loolakoola.com must notify the following contents in advance and the customers may withdraw this consent at any time. The following contents include the information of Personal Information Protection Manager (affiliation, name, phone number, email), purposes of collection and use of customer’s personal information, and details of customer’s personal information disclosure (recipient, purpose, personal information provided). These items are stipulated by Article 22(2) of the 「Act on Promotion of Information and Communications Network Utilization and Information Protection」.
6) The customers have the right to access and request correction of the customer’s personal information. If a customer requests correction of an error, loolakoola.com will process the request immediately and will not use that particular personal information until the error is corrected.
7) To protect personal information, loolakoola.com minimizes the number of individuals handling customer’s personal information. loolakoola.com takes responsibility for any damages due to loss, theft, leakage, unauthorized disclosure to third parties, alteration, and other incidents involving customer’s personal information such as credit card and bank account details. However, if loolakoola.com proves that there was no intention or negligence on its part, loolakoola.com will not be responsible for any damages.
8) loolakoola.com and third parties that have received personal information from loolakoola.com must promptly remove provided information when the purpose of collection has been achieved.
9) loolakoola.com does not pre-select the consent box for the Privacy Policy. Loolakoola.com clearly states specific services that may be restricted due to customer’s refusal regarding the collection, usage, or disclosure of personal information. loolakoola.com does not restrict or refuse services such as membership registration based on a customer’s refusal for non-mandatory collection, usage, or disclosure of personal information.

 

18. Obligations of the loolakoola.com

1) loolakoola.com will not engage in any acts prohibited by laws and the Terms and Conditions and will do its best to provide services continuously and stably in accordance with laws and the Terms and Conditions.
2) loolakoola.com must have security system to protect customer’s personal information so that the customers can use loolakoola.com safely.
3) If loolakoola.com engages in unfair representations or advertising practices specified in Article 3 of the 「Act on Fair Labeling and Advertising」 and causes any related damages to customers, loolakoola.com will be responsible for compensation.
4) loolakoola.com will not send unwanted promotional emails to customers.

 

19. Obligations of Customers regarding ID and Password

1) Except in the case of Paragraph 17(Protection of Personal Information), the responsibility for managing the ID and password is solely on the customers.
2) A customer must not allow any third parties to use the customer’s ID and password.
3) If a customer's ID and password are stolen or being used by a third party without authorization, the customer must immediately notifies us and follows provided instructions.

 

20. Obligations of Customers

1) Do not provide false information in any cases.
2) Do not steal and use someone else's personal information.
3) Do not modify information posted on loolakoola.com.
4) Do not transmit or post any information other than the information specified by
loolakoola.com.
5) Do not violate copyrights or other intellectual property rights of loolakoola.com or third parties.
6) Do not damage the reputation of loolakoola.com and LOOLAKOOLA or interfere with business.
7) Do not publish or post obscene or violent messages, images, audio or other contents on the website.

 

21. Relationship between loolakoola.com and linked website

Customers may be directed to other websites through hyperlinks such as text, images, or multimedia. loolakoola.com does not take any responsibility for transactions provided by the linked websites.

 

22. Ownership and Restriction of Copyright

1) Intellectual property rights including copyright for the contents created on loolakoola.com belong to LOOLAKOOLA.
2) Customers are not allowed to reproduce, transmit, publish, distribute, broadcast, or use for commercial purposes any information obtained from loolakoola.com that is owned by LOOLAKOOLA without prior approval.
3) If loolakoola.com uses the copyright belonging to the customer according to an agreement, it must notify the respective customer.

 

23. Dispute Resolution

1) loolakoola.com establishes and operates a damage compensation department to reflect and to compensate for reasonable opinions or complaints raised by the customers.
2) loolakoola.com prioritizes the handling of opinions and complaints from the customers. If prompt resolution is not possible, the reasons and expected processing schedule will be promptly notified.
3) In case of e-commerce disputes between loolakoola.com and the customer, the customer’s request for dispute resolution can be subject to mediation by the Fair Trade Commission or a dispute resolution institution commissioned by the local government.

 

24. Jurisdiction and Governing Law

1) Any legal action regarding e-commerce disputes between loolakoola.com and customers shall be filed with the local district court having jurisdiction over the customer's address at the time of filing. The district court with jurisdiction over the customer's residence has jurisdiction, if there is no address. In case the customer's address is not clear or if the customer is a foreign resident, the lawsuit shall be brought in the court with jurisdiction under the 「Civil Procedure Act」.
2) South Korean law shall be applied to any e-commerce lawsuit filed between loolakoola.com and the customers.
